Pollution Liability


In the maritime context, Pollution Liability refers to the legal responsibility borne by a shipowner or operator for any environmental damage caused by the discharge of harmful substances from their vessel into the sea. This liability can arise from accidental spills of oil or other hazardous materials, or from the deliberate dumping of waste. The extent of the liability is usually determined by international conventions, such as the International Convention on Civil Liability for Oil Pollution Damage, and national laws. The shipowner or operator may be required to pay for the clean-up costs, compensate those affected by the pollution, and may also face fines or other penalties. To manage this risk, shipowners and operators often take out pollution liability insurance, which covers the costs associated with pollution incidents. However, the insurance does not absolve them of their responsibility to operate their vessels in an environmentally responsible manner.
