Innocent Passage


Innocent Passage refers to the right of all ships to pass through the territorial waters of another state, subject to certain conditions. According to the United Nations Convention on the Law of the Sea, innocent passage is defined as the passage of a ship through the territorial sea for the purpose of traversing that sea without entering internal waters or calling at a roadstead or port facility outside internal waters. The passage must also be continuous and expeditious. The coastal state may not suspend innocent passage, but it may regulate the passage of foreign ships through its territorial waters, including requiring prior notification of passage. Any exercise or practice with weapons is prohibited during innocent passage.
